1. Definitions and Applicability
1.1 Definitions
In these Terms and Conditions:
“AFC Southgate”, “the Club”, “we”, “us” or “our” means AFC Southgate Ltd.
“Parent” means the parent, legal guardian or other authorised adult responsible for making a booking or purchasing a Membership on behalf of a Player.
“Player” means the individual registered to participate in AFC Southgate coaching, training, matches or other football activities.
“Membership” means an arrangement under which a Player is registered to attend AFC Southgate coaching Sessions and for which payment is made on a recurring or termly basis.
“Session” means a football coaching, training or other sporting session organised by AFC Southgate.
“Venue” means the location at which a Session, match or other AFC Southgate activity takes place, as communicated to the Parent or Player.
“Website” means afcsouthgate.com.
1.2 Applicability
These general conditions apply to:

the purchase of AFC Southgate coaching services and branded products through the Website; and
-
the use of any information, documents, graphics, videos, features, music and/or other services on the Website and AFC Southgate’s associated social media channels.
2. Ordering and Purchasing Through Our Website
2.1 Eligibility to Order or Purchase
To place an order through our Website, you must:
-
be 16 years of age or older; and
-
be a consumer and not a reseller.
You need an email address to book a trial Session or place an order.
Making a booking through our Website is easy:
-
Select the Session.

Click “Book”.
-
Select the date and time.
-
Fill in your details.
-
Click “Book now”.

Receive an automated email confirmation of your booking.
A copy of the automated order confirmation will be sent to your email address. We strongly suggest that you print or download this copy for future reference.
We expressly reserve the right not to accept your order or to cancel the purchase agreement after the automated order confirmation has been sent.
2.2 Our Right Not to Accept or to Cancel Your Booking
We reserve the right to refuse any order for whatever reason.
We also reserve the right to cancel any booking or order already accepted by us in, among other circumstances, the following situations, without being liable for any resulting loss or costs:

the product or coaching service is not available or is out of stock;
-
the information you have provided is incorrect or cannot be verified;
-
your booking is flagged by our security systems as an unusual order or an order that may be susceptible to fraud;
-
we have reason to believe that you are under 16; or
-
we have reason to believe that you are a reseller.
3. Prices and Payments
3.1 Payment Methods
The main form of payment we accept for our football Sessions is monthly Direct Debit.
If you do not wish to pay by Direct Debit, we can accept cash or BACS. However, payment by cash or BACS must be made for a whole term in advance.
We do not accept any payment method other than those clearly stated on our Website, as our system is not designed to process other payment methods.
Please do not attempt to pay by any other method. If you do, we will not be liable for the loss of the payment or any other loss that may result from this action.
3.2 Direct Debit Payments
AFC Southgate Ltd uses the Access PaySuite platform to process Direct Debit payments for coaching services.
Direct Debits can be set up on any date, and the first payment will be issued on the following first day of the month.
Please see section 4.1 for our Direct Debit cancellation terms.
3.3 Tax Charges
AFC Southgate Ltd is a VAT-registered company.
3.4 Price Changes
The product prices displayed on the Website may be subject to change.
We reserve the right to change prices without notice. The prices displayed at the time of purchase are the prices applicable to that purchase.
3.5 Pricing Errors
Although the Website is prepared with care, it is possible that errors in pricing information may occur.
We are not bound by an incorrect price displayed on the Website, and we reserve the right to cancel your purchase in the event of a pricing error.
4. Cancellations, Exchanges and Refunds
4.1 Direct Debit Cancellations and Cancellation of Football Classes
If you wish to cancel your Direct Debit and football Membership, AFC Southgate must be given at least seven days’ notice before the start of the month from which you wish to cancel.
Cancellation requests must be submitted by email to:
If we do not receive at least seven days’ notice, we may be unable to prevent the Direct Debit payment from being collected on the first day of the following month and will not be liable to issue a refund for that payment.
We will not be liable to refund a Direct Debit payment where the required seven days’ cancellation notice was not provided.
Nothing in this section or elsewhere in these Terms and Conditions affects your statutory rights.
5. Liability
5.1 Liability Relating to Merchandise and the Website
If you suffer loss in relation to our activities on the Website, our liability will be limited to:
a. loss of or damage to AFC Southgate equipment or other materials;
b. reasonable and demonstrable costs incurred by you to establish the cause and amount of the loss or damage referred to under paragraph a; and
c. reasonable and demonstrable costs incurred by you to prevent or reduce the loss or damage referred to under paragraph a.
The maximum reimbursement for the losses described above will, where applicable, be limited to the purchase price of the products concerned.
We shall not be liable for losses incurred by a third party resulting from the use of any of our products.
We shall not be liable for losses incurred by you as a result of your improper use of any of our products.
We are not liable for losses resulting from incorrect information on our Website.
AFC Southgate Ltd maintains an extensive public liability insurance policy tailored to sporting activity and the supervision of children.
Our liability will not cover:
-
the safety and welfare of individuals registered for our training Sessions or matches outside AFC Southgate activities or operational supervision;
-
the safety and welfare of any individual who is not registered with AFC Southgate;
-
food poisoning resulting from the consumption of food brought from outside our facilities;
-
loss or theft of items belonging to individuals registered to attend our Sessions where that loss or theft results from their own negligence.
6. User-Generated Content
6.1 Website and Social Media Channels
If you post any ideas, remarks, questions, data, graphics, opinions, designs or other information on our Website or social media channels, or if you send such user-generated content through the Website to AFC Southgate, this will become the exclusive property of AFC Southgate.
User-generated content will be treated as non-confidential, and we will be entitled to use or disclose it in any manner whatsoever without liability or notice to you.
User-generated content or any other information that you submit to the Website or AFC Southgate’s social media channels must not contain material that is offensive, pornographic, defamatory, blasphemous, unlawful or likely to infringe any applicable civil, criminal or religious law.
You agree that all material submitted to us is original to you and has not been copied, in whole or in part, from any third party.
Please do not send anything that is required to be kept confidential.
AFC Southgate does not review all user-generated content, and you agree that AFC Southgate has no obligation to do so.
AFC Southgate is not responsible for user-generated content, does not guarantee its accuracy, integrity or quality, and cannot guarantee that harmful, inaccurate, deceptive, offensive, threatening, defamatory, unlawful or otherwise objectionable user-generated content will not appear on the Website or AFC Southgate’s social media channels.
You acknowledge that, by providing you with the ability to access and view user-generated content through the Website or social media channels, AFC Southgate is acting as a passive conduit for its distribution and is not accepting any obligation or liability relating to that user-generated content or the activities of users.
The information, materials and opinions expressed or included in user-generated content are not necessarily those of AFC Southgate or its affiliated or related entities or content providers.
You acknowledge and agree that AFC Southgate has the right to monitor user-generated content posted to the Website or social media channels at its sole discretion.
AFC Southgate reserves the right to alter, edit, refuse to post or remove user-generated content, in whole or in part, for any reason or no stated reason, and to disclose user-generated content and the circumstances surrounding its transmission to any third party.
You agree that we are not required to use or respond to user-generated content.
You agree to notify AFC Southgate immediately in writing if you become aware of objectionable content appearing on the Website.
Any use of content on the Website or social media channels, including user-generated content, is at your own risk.
You acknowledge and agree that AFC Southgate is not responsible for any user-generated content that claims to provide medical advice or advice regarding fitness training, exercise or diet.
Always seek the advice of a physician or other qualified health provider with any questions you may have regarding a medical condition or physical fitness programme.
You may not post or otherwise distribute content to the Website or AFC Southgate’s social media channels that AFC Southgate, at its sole discretion, considers to be:

abusive;

harassing;

threatening;

defamatory;

obscene;

an impersonation of another person;
-
fraudulent;
-
deceptive;
-
misleading;
-
in violation of another person’s copyright, trademark or other intellectual property rights;

in violation of any other right belonging to AFC Southgate or another party;

illegal; or
-
otherwise objectionable to AFC Southgate.
You may not upload commercial content to the Website or AFC Southgate’s social media channels or use the Website to solicit others to join or become members of another commercial online service or organisation.
6.2 Use of Information Submitted
To the extent that you own intellectual property rights in user-generated content, those rights will be transferred by you to AFC Southgate when you post the user-generated content on our Website or social media channels or send it to AFC Southgate.
You agree and guarantee that AFC Southgate is free to use any part of the user-generated content posted or sent by you, created by you while accessing our Website, or contained in any communication you send to AFC Southgate or submit through our Website or social media channels.
AFC Southgate may use this content without notice, compensation or acknowledgement to you for any purpose, including developing, manufacturing and marketing products and services and creating, modifying or improving the Website or other products or services.
You acknowledge and agree that you will have no claim against AFC Southgate or any other party if user-generated content created, posted or sent by you is used by AFC Southgate or another authorised party in this manner.

7. Applicable Law
These Terms and Conditions and all disputes arising in connection with them, including disputes concerning their validity, use of the Website or purchases made through the Website, shall be governed by the laws of England and Wales.
8. Information on Our Website and Social Media Channels
Although AFC Southgate prepares its Website and social media channels with care, the information, text, documents, graphics, videos, music and/or other services made available through them may contain errors or may otherwise be incorrect or incomplete.
AFC Southgate shall not be liable for losses resulting from the use of, or inability to use, the Website or social media channels, including losses caused by viruses or by incorrect or incomplete information, unless the loss results from wilful misconduct or negligence on the part of AFC Southgate.
9. Linked Websites
Our Website and social media channels may provide links to external websites.
AFC Southgate shall not be liable for the use or content of external websites that link to the Website or that are linked from it.
10. Trademarks and Copyright on the Website
All brand names, product names and titles used on the Website are trademarks or trade names belonging to AFC Southgate Ltd or third-party trademark or trade name holders.
You are not permitted to use or reproduce any such trademarks or trade names, as doing so may constitute an infringement of the rights of their respective owners.
All Website designs, text, documents, videos, music and/or other services, their selection and arrangement, all software compilations, underlying source code, software and all other material on the Website are protected by copyright belonging to AFC Southgate or its suppliers.
You are permitted to electronically copy and print portions of the Website only to the extent necessary to place an order with us or use the Website as a shopping resource.
You are not permitted to make any other use of the information and materials on the Website, including reproduction for purposes other than those described above, modification, distribution or republication.
If you wish to use materials or information from the Website, you must obtain AFC Southgate’s prior written consent.

Notices sent by email will be treated as received when they are successfully delivered to the relevant email address, unless the sender receives a delivery failure notification.
12. Statutory Rights
Nothing in these Terms and Conditions excludes, limits or affects any rights or remedies that cannot lawfully be excluded or limited under the laws of England and Wales.
Your statutory rights as a consumer are not affected.
